Rental investment

Can you rent to your children?

Not all tax relief schemes allow you to let your property to a family member. While this is permitted under the Pinel law and the Denormandie scheme (but only if your child is not a member of your tax household), it is not possible under the Malraux scheme or the Loc'Avantages scheme. There are no restrictions under the LMNP (loueur en meublé non professionnel) scheme. However, a tenancy agreement must be duly signed, and the rent charged must be in line with the market, even if the tenant is a member of your family. If you fail to comply with these provisions, the tax authorities may ask you to return the tax benefit you have received.
